The Supreme Court’s decision in Reeves v. Sanderson Plumbing, was a welcome tool to combat employers’ efforts to have employment cases dismissed at summary judgment where plaintiffs tried to prove their case based upon circumstantial evidence. But the 10th Circuit’s decision in E.E.O.C. v. Picture People, created a barrier to the proper application of the holding of Reeves.
